What is PJM Interconnection?
PJM is the nation’s largest regional transmission organization. It runs the electric grid and electricity markets that affect what we pay, how reliable service is, and how much pollution power generation creates.
Why an Energy Bill of Rights?
PJM’s 2026 reform process can’t be limited to incremental tweaks. It needs a paradigm shift that treats the public as the primary stakeholder, because failure risks PJM’s legitimacy and its ability to maintain a reliable, affordable grid.
THE ENERGY BILL OF RIGHTS
Below are the core rights the public deserves from PJM’s market redesign.
1) The Right to Affordable, Reliable Energy
Electricity is an essential service, not a luxury.

Protection from price spikes: Extend the existing capacity price cap while long-term reforms are finalized.

No public subsidies for corporate speculation: Stop over-procuring based on speculative demand forecasts; focus on verified projects with meaningful financial commitments.

Lower-cost, reliable solutions: Ensure market rules fully value affordable, reliable clean energy that can reduce costs in other regions.
2) The Right to Data Center Accountability
If massive new energy users trigger billions in grid upgrades and higher energy costs, they must foot the bill.

No more subsidizing data centers: Costs driven by large loads must not be passed to the public; PJM and states should directly allocate costs to the loads driving demand.

Prioritize community reliability: Large users that connect without bringing new clean energy should be first to curtail if there isn’t enough power.
3) The Right to a Modern, Reliable Clean Energy Grid
The fastest, most affordable new power comes from renewables and storage. We deserve a grid that lets them compete fairly.

Eliminate the interconnection bottleneck: Create a fast, fair process to connect new resources; address transmission bottlenecks.

Level the playing field: Fully credit renewables and storage for the reliability they provide; enable clean replacements for retiring fossil plants without downtime.

Grid optimization first: Use the existing grid to its full potential before building expensive new lines; prioritize grid-enhancing technologies and transparency.

Fair allocation of transmission costs: Data centers should pay for upgrades and supply built to serve them.
4) The Right to Transparent Governance
PJM’s governance is dominated by companies that profit from its decisions. The public deserves a seat at the table.

Public representation: Ratepayers, states, consumer advocates, and public utility commissions must have meaningful power in PJM decisions; PJM should record, transcribe, and publish stakeholder discussions and votes.

Respect for state authority: PJM must support state clean-energy laws and engage constructively in state planning.
